Terms and Conditions

1. All players must be at least 19 years of age in order to play in the World Poker Tour North American Championship satellite events online at Cakepoker.com. Should a player win a seat to a land based event and not meet the legal age required to participate in the event, their seat shall be forfeited without compensation. All players will be required to produce proof of age (passport or other valid picture ID).
2. Employees and immediate family members of employees of Cake Gaming N.V. and its associated companies are not eligible to take part in the Promotion.
3. Cake Gaming N.V. reserves the right to alter, modify or terminate the Promotion and/or these Terms at any time, without notice where it is reasonable to do so or for reasons beyond their control. Cake Gaming N.V. does not accept any responsibility or liability for any late or undelivered entries or registrations, notifications or communications or for any form of technical failure, error, malfunction or difficultly or for any other event beyond its reasonable control that may cause the operation of the Promotion to be disrupted, unavailable or incorrect.
4. Players participating in World Poker Tour qualifiers at Cakepoker.com agree to the terms and conditions of the Cakepoker.com Player Agreement.
5. Cake Gaming N.V., as the operator of the Cake Poker Network, guarantees one World Poker Tour prize package will be awarded per $12,000 in the prize pool.
6. Cake Poker has valued the $10,300 CDN WPT North American Championship main event seat at $10,200 USD based on current exchange rates.
7. Players winning a $12,000 World Poker Tour prize package will be paid the value of the prize package win in the following manner:
   1. $10,200 USD will be used to register the player in the WPT North American Championship main event playing October 10th to 16th, 2008. Cake Gaming N.V. is responsible for registration of the winning player.
   2. $1,800 USD will be paid to the winner's real money account balance upon receipt of a valid piece of photo I.D. showing proof of age (min. 19 years).
8. By participating in a Cake World Poker Tour qualifying tournament, participants grant Cake Gaming N.V. the right to the players name and likeness for future promotional purposes without further compensation.
9. Players who qualify for the World Poker Tour North American Championship event at Cakepoker.com agree to wear Cake Poker.net apparel for the duration of the event when permitted to do so by the tournament rules. Apparel will be supplied by Cake Gaming N.V. before the commencement of the tournament.
10. Players note that the World Poker Tour and/or WPT Host Casino will require them to sign an agreement or waiver to participate in the event that may include permission to film and broadcast. Cake Gaming N.V. shall owe no compensation to any player should they not wish to adhere to this third party agreement.
11. World Poker Tour prize packages are non redeemable for cash value and are non transferable. The name and person registered on the player's account must participate in the live event.
12. One World Poker Tour $12,000 prize package will be permitted per player across the Cake Poker Network.
13. One WPT Prize Package on the Cake Poker Network per player will be permitted. As a World Poker Tour player, winners agree to the following WPT Guidelines & Regulations:
    1. Grant of Rights: The Player acknowledges that Cake Gaming N.V. and/or its successors, assigns and licensees will be photographing and exploiting films and/or television specials or other audiovisual works of and/or about the WPT (jointly and severally the "Programs"). The Player consents to such filming and exploitation of the Programs, and hereby irrevocably grants to Cake Gaming N.V. the right to film, record, edit, reproduce and otherwise use Player's name, Cake Poker Network Player ID, likeness, biographical information, appearance, actions, conversations (including, without limitation, "behind the scenes" footage and filmed interviews with Player) and/or voice (the "Recordings") in, and in connection with, the Programs and in connection with the advertising, publicizing, exhibition and exploitation thereof and of other audio-visual works and any and all derivative, subsidiary and/or ancillary uses related thereto, in whole or in part, by any and all means, media, devices, processes and technology now or hereafter known or devised in perpetuity throughout the universe.
    2. Release of Rights: The Player agrees that they will make no claim of any kind against Cake Gaming N.V. as a result of any of the uses described above, and irrevocably and unconditionally waives and releases Cake Gaming N.V. and its invitees, participants, from all claims arising out of such use, including, without limitation, any claims for invasion of privacy, infringement of Player's right of publicity, defamation (including libel and slander) and any other personal and/or property rights. The Player hereby confirms that Player has the authority to grant to Cake Gaming N.V. the right to use the Recordings and that Cake Gaming N.V.'s exercise of such rights shall not violate or infringe any rights of any third party. The Player understands that Cake Gaming N.V. has been induced to proceed with the production, distribution and exploitation of the Programs in reliance upon this agreement.
    3. Non-transferability: WPT prize packages are non-transferable: Qualifiers cannot sell, transfer, or award their WPT seat to anybody else. The ID of the finalist will be checked against your Cake Poker Network account details and proof of age, identity and address will be required.
    4. Ability to travel: All final table qualifiers will be required to hold a valid passport.
    5. The WPT North American Poker Championship main event will be played live October 10th to 16th, 2008 at the Fallsview Casino, in Niagara Falls, Ontario Canada. Qualifiers unable to attend the final table will be posted and folded until their chips are gone and their final position and any prize money determined. There is a limit of one WPT Seat per player and all players must be of the legal age of majority as determined by the laws of the country in which they reside.
14. Cake Gaming N.V. Management decisions are final on all matters related to the Promotion or the awarding of prizes.
